In accordance with the European Electronic Communications Code (Directive (EU) 2018/1972) (the 'EECC'), Adzsend is required to provide relevant users with the following information about the electronic communications service we provide as part of Adzsend. This information supplements the terms of use of these services. This addendum further sets out the information required under the Telekommunikationsgesetz 2021 ('TKG 2021').
Adzsend services are provided without minimum contract terms. Users may terminate their use of Adzsend services at any time, as described in Adzsend's Terms of Service.
Access to the Adzsend Bridge application and dashboard is provided via tiered subscription plans. Users on the 'Free Tier' may access the services at no cost, subject to the features and limitations of that plan. Users are responsible for the costs of their data plan and internet access.
To use Adzsend, you'll need to register an account with us. To do this, we ask you to provide us with a way of contacting you (an email address).
We take a number of steps to help protect your information. All information sent within our services is encrypted both in transit and at rest. For example, we use Transport Layer Security ('TLS') to encrypt text and credentials in transit. We also enforce technical and administrative access controls to limit which of our employees and contractors have access to non-public personal information.
The Terms of Service set out limitations on Adzsend's liability in connection with your use of the services. These limitations are subject to certain exclusions that we have described in the Terms of Service, including that such limitations will not affect your mandatory legal rights and remedies (such as statutory warranties) provided to you under Austrian law to the extent they apply.
If you have any questions, you can contact us at '[email protected]'. Adzsend's Terms of Service set out how disputes will be handled between us, including information on which governing law and venue applies. In addition, where permitted under the TKG 2021, you may be able to refer such cases for dispute resolution to the Rundfunk und Telekom Regulierungs-GmbH (RTR), A-1060 Wien, Mariahilfer Straße 77–79.
